On 17 August 2021, the CDPP withdrew criminal cartel charges against the CFMMEU and Mr O’Mara. Combined with the acquittals in the Country Care case and recent developments in the $2.5 billion ANZ share placement case, this prompts reflection on the pursuit of criminal proceedings to deter companies, their executives and employees from engaging in cartel conduct.
After more than four years of investigations by the ACCC, on 23 August 2019 the Commonwealth Director of Public Prosecutions (CDPP) charged Wallenius Wilhelmsen Ocean AS (WWO), a Norwegian-based global shipping company, with criminal cartel conduct.
