The introduction of consumer class actions in France

On 1 October 2014, a new class action regime came into effect in France, which permits duly authorised consumer associations to commence proceedings requesting damages for individual harm suffered by consumers placed in a similar or identical situation as a result of  anti-competitive practices.

On the same day as the legislation was passed, the leading authorised consumer association published a press release stating that it will be bringing a class action against a national real estate agency and claiming damages of €44 million further to a judgment on 3 December 2013 that established a breach of the prohibition to invoice fees for rent receipts.
