On Valentine’s Day, 14 February 2012, the ACCC played relationship counsellor in the telco space by ‘declaring’ wholesale ADSL services under section 152AL of the Competition and Consumer Act 2010 such that access to those services is regulated under the Act.
The ACCC commenced an inquiry into the declaration on 16 December 2011, focusing on regional areas, in which Telstra has a higher market share.
The interim declaration will last 12 months, and will remain in place while the ACCC decides whether to make a final access determination later this year, which would then last for a five year period.
