Copyright case of Olympic proportions

Just before Christmas last year, Justice Bennett handed down the decision in Seven Network Limited v Commissioner of Taxation [2014] FCA 1411 which held that no copyright existed in Channel Seven’s live television broadcasting of the 2006 (Winter) Olympics in Turin, and the 2008 Olympic Games in Beijing, to Australian viewers.

Patent settlements are up and anti-competitive behaviour is down: EU

The European Commission recently released a report on patent settlement agreements between originator and generic companies in the European pharmaceutical sector which shows a continued low level (7% in 2012) of potentially anti-competitive settlements. The report is the fourth of its kind since the Commission's competition inquiry in the pharmaceutical sector which concluded in July 2009 (see IP/09/1098 and MEMO/09/321), and draws upon the patent settlement agreement results of 53 originator and 66 generic companies.

Pinterest pins down Pintrips

On 4 October 2013, social media pinboard site Pinterest filed an action in the United States District Court against Pintrips, “a personal travel planning dashboard”, for trade mark infringement, false designation of origin, unfair competition and trade mark dilution. This apparently followed months of polite requests from Pinterest to Pintrips to stop this alleged “illegal conduct”. Not all these causes of action are available in Australia, so this discussion will focus on the trade mark fight.

Spot The Difference: Ministry of Sound sues Spotify for copyright infringement

To those who have ever created an awesome Ministry-esque playlist on Spotify – you may have just got them into trouble. In September this year, Ministry of Sound, famous for their dance music compilations (think “Addicted to Bass”, “Sessions”, “Chillout Sessions” and the now-ironically named “On the Download”), have sued Spotify for copyright infringement in the UK High Court.

Turtle vs Tata “Pacs” a punch

On 14 July 2010, Tata Sons, the intellectual property holding company for the Indian industrial conglomerate the Tata Group, applied for an injunction against Greenpeace India for using its “T within a circle” device in a virtual game on the Greenpeace website.
