The Hong Kong Competition Commission (“HKCC”) has released a draft leniency policy for comment.
Similarly to the ACCC’s policy, the HKCC’s draft leniency policy is designed to encourage companies to report cartel conduct. In exchange for reporting cartel conduct, the “first in” cartel member will be offered leniency (up to full immunity), which will extend to that member’s current directors, employees and officers. Other cartel members that co-operate may be offered favourable treatment.
The HKCC has asked for comments to be provided by 23 October 2015.
